WeLab Bank Daily Dining Offer 2021 Terms & Conditions

[1] The WeLab Bank Daily Dining Offer 2021 (“Offer”) period shall be from 1 August 2021 to 31 October 2021 (both dates inclusive) (“Offer Period”), unless otherwise specified.

[2] The Offer applies to a Welab Bank Limited’s (“WeLab Bank”, “we”, “us” or “our”) customer (“you” or “your”) who holds a valid bank account with us within the Offer Period. Your WeLab Debit Card will be automatically enrolled to the Offer.

[3] During the Offer Period, your Eligible Transactions (as defined hereinbelow) will be entitled to either the base rebate (“Base Rebate”) or the special rebate (“Special Rebate”) according to the following table. Each customer can earn up to HKD 500 rebate in total under this Offer (i.e. the total amount of Base Rebate and Special Rebate) in each calendar month.

(Transaction time will be based on Hong Kong Time (HKT))

For example:

(a) If you conducted 9 Eligible Transactions in August 2021, all Eligible Transactions of that month will be entitled to 1% Base Rebate.

(b) If you conducted 15 Eligible Transactions in September 2021, 7 Eligible Transactions of which fall into the food and beverage category:

(i) 7 Eligible Transactions which fall into the food and beverage category will be entitled to 3% Special Rebate; and

(ii) The remaining 8 Eligible Transactions which do not fall into the food and beverage category will be entitled to 1% Base Rebate.

[4] Eligible transaction is defined as transactions conducted using your WeLab Debit Card (including (i) your virtual and physical WeLab Debit Card and (ii) your WeLab Debit Card which have been added in your mobile wallet) within the Offer Period in any currency (“Eligible Transaction”). If the Eligible Transaction is made in a currency other than Hong Kong Dollars, the cash rebate will be calculated based on Hong Kong Dollars after conversion at the applicable exchange rate.

[5] We may notify you the number of transactions that you have conducted in a calendar month electronically (for example, by email, push notification or in-app notification). However, such notification is for reference only and your final entitlement to the Special Rebate (3%) in such calendar month shall be solely determined by number of Eligible Transactions according to your settled transaction records with us (i.e. pending transactions are excluded), which can be accessed through the App.

[6] Our decision as to what constitutes an ineligible or Eligible Transaction (as the case may be) shall be final and conclusive. Ineligible transactions, shall include but are not limited to the below: (a) payment of banking fees and charges (including but not limited to annual fee, overdrawn fee, card replacement fee, ATM cash withdrawal fee, if applicable); (b) quasi-cash transactions including: (i) betting and gambling transactions; (ii) instalment payments; (iii) balance transfers; (iv) cash, token, vouchers payment and/or foreign exchange transactions at non-financial institutions (including cash coupon purchases, purchase of foreign currency, money orders and travelers’ cheques); and/or (v) any transactions at other financial institutions (including purchase of merchandise and services from banks); (c) bank transfers (by way of Faster Payment System, SWIFT, eDDA, etc.); (d) bill payments (including but not limited to water bills, electricity bills, insurance premiums, payments to other banks and credit cards, etc.); (e) tax payments to the Inland Revenue Department; (f) purchase and/or reload of stored value cards or e-wallets; and/or (g) unposted, cancelled and/or refunded transactions, in whole or in part. We may add to, or remove from, the list of ineligible transactions from time to time at our sole discretion.

[7] Whether an Eligible Transaction falls into the food and beverage category depends on the merchant category code/transaction type as defined between the merchants and MasterCard Asia/Pacific (Hong Kong) Limited.

Examples of merchant which may fall into the food and beverage category (including but not limited to): Restaurants, bars, restaurants’ online food ordering, online food delivery platforms, hotel restaurants & bars, nutrition stores.

[8] For the avoidance of doubt, all Eligible Transactions will be entitled to either Base Rebate (1%) or Special Rebate (3%) according to Clause 3 above. No transaction can enjoy both Base Rebate and Special Rebate.

[9] The equivalent cash rebate amount for each calendar month will be credited into your Core Account within 10 working days from the 1st day of the next calendar month.

[10] Transactions which have been cancelled or reversed in full will not be counted as Eligible Transactions. If the total number of Eligible Transactions conducted in a calendar month becomes 9 or fewer after cancellation or reverse of any transaction in full, you will not be entitled to any Special Rebate for any Eligible Transaction conducted in that calendar month.

[11] If you have subsequently cancelled or reversed any transactions (in full or partial amount)in respect of which cash rebate amount has been credited to your Core Account, we reserve the right to debit (i) the respective cash rebate amount and (ii) any cash rebate difference (applicable if the cancellation or reverse of the transaction in full results in the loss of entitlement to the Special Rebate of a calendar month pursuant to Clause 10 above) directly from your Core Account without prior notice.

[12] The cash rebate amount will be rounded to the nearest cent.

[13] All cash rebate amount cannot be transferred, returned, exchanged, or converted into other forms, unless otherwise specified by us.

[14] You agree and acknowledge that you are not entitled to receive any cash rebate amount if you close your Core Account at any time before the cash rebate amount is credited to your Core Account in the applicable calendar month.

[15] Any breach of applicable laws or regulations, fraud, abuse and/or non-compliance by you (as determined at our sole discretion) will result in forfeiture of your eligibility to participate in the Offer and/or suspension or termination of all or any of your Account with us. We shall not credit the cash rebate amount or where the cash rebate amount has been credited, we reserve the right to debit the cash rebate amount from your Account (including but not limited to your Core Account) without notice and/or take such necessary legal action to recover any outstanding amounts.

[16] We reserve the right to suspend, modify or terminate this Offer and/or amend these terms and conditions at any time without prior notice. In the event of dispute, our decision shall be final, conclusive and binding.

[17] Terms defined in our Account Terms shall have the same meanings when used herein, unless otherwise defined.

[18] These terms and conditions shall be read in conjunction with our Account Terms. In the event of discrepancies or inconsistencies between these terms and conditions and the Account Terms, these terms and conditions shall prevail.

[19] In the event of any discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.
