Eason Chan Concert Promotion – Investment Edition Terms and Conditions

[1] Eason Chan Concert Promotion – Investment Edition (“Promotion”) runs from 21 November to 2 December 2022 of Hong Kong Time (“HKT”) (both dates inclusive) (“Promotion Period”).

[2] By participating in this Promotion, you acknowledge that you have read and agreed to these Promotion terms and conditions.

[3] In these terms and conditions:

(i) “Eligible Transaction” shall mean subscription for mutual fund(s) via Wealth Management Services in the WeLab Bank App, covering one-time investment and monthly investment.
(ii) “Accumulated New Investment Amount” within a period shall be equal to the accumulated investment amount of all Eligible Transactions during such period. However, if any mutual fund position of your Eligible Transaction(s) within such period is redeemed at or before the end of such period, the redemption amount (after being converted into HKD on the transaction date based on the relevant prevailing foreign exchange rate determined by us and rounded to the nearest cent) shall be excluded from counting towards the Accumulated New Investment Amount within such period. Accumulated New Investment Amount will be rounded to the nearest dollar.
(iii) Transaction time will be based on HKT.

[4] The Promotion is applicable to customers (“Eligible Customers”) of Welab Bank Limited (“WeLab Bank”, “we”, “us” or “our”) who meet following conditions:

(i) Own a valid WeLab Bank Core Account and Investment Account (as determined by us at our sole discretion) during Promotion Period and until 31 March 2023; and
(ii) Successfully complete all the following missions (“GoWealth Investment Missions”):

(a) Completed the registration through the promotion page in WeLab Bank app (as shown below, “Promotion Page”) within the Promotion Period (“Registration”):

(b) Attained the Accumulated New Investment Amount of at least HKD 5,000 within the Promotion Period.

Note: Order cut-off time is 3:00pm HKT of a dealing day. If you place an order at or after the cut-off time or on a non-Business Day/non-dealing day of the fund, your order will be processed on the next Business Day. Therefore, subscription order placed at or after 3:00pm HKT of 2 December 2022 will not be processed on or before 2 December 2022, and its relevant investment amount will not be counted towards the Accumulated New Investment Amount within the Promotion Period.

[5] Subject to Clauses 6 to 8 below, Eligible Customer can get 2 concert tickets of FWD Presents: FEAR AND DREAMS EASON CHAN IN CONCERT (“Concert”) according to the ticket price selected by you during the Registration (“Ticket Reward”). Each Eligible Customer can only participate in the Promotion once during the Promotion Period. Please visit [https://www.easonchan.net/hk/?lang=en] for the Concert details.

[6] Ticket Reward is subject to an handling fee of HKD 1,400 (if you selected HKD 680 as the ticket price of your Ticket Reward) or HKD 2,000 (if you selected HKD 980 as the ticket price of your Ticket Reward), which will be withheld from your HKD Core Account on or before 5 December 2022 and debited within one month after 31 March 2023. However, if you have attained the Accumulated New Investment Amount of at least HKD 30,000 (if you selected HKD 680 as the ticket price of your Ticket Reward) or HKD 50,000 (if you selected HKD 980 as the ticket price of your Ticket Reward) within the period from 21 November 2022 (i.e. first day of the Promotion) to 3pm HKT of 31 March 2023, you will be waived from charging any handling fee for the Ticket Reward and the handling fee withheld from your HKD Core Account will be released within one month after 31 March 2023.

Note:

(a) Relevant handling fee to be withheld will not be counted in the “Available Balance” of your Core Account shown in Welab Bank app, while the amount will still be counted as the balance of your Core Account on the bank statement.
(b) In case where the relevant handling fee has been withheld from your HKD Core Account, and you ultimately cannot get the Ticket Reward due to any reason (e.g. due to any redemption of your investment made within the Promotion Period or quota full), the relevant withholding will be released on or before 12 December 2022.

[7] You should ensure your Core Account have sufficient available balance so that we can withhold the handling fee on or before 5 December 2022, failing which your Ticket Reward will be forfeited.

[8] Available quotas are limited for the Ticket Rewards and the Ticket Rewards are available on a first-come-first-served basis, based on the time of completion of (i) all the GoWealth Investment Missions and (i) the withholding of the handling fee pursuant to Clause 6 hereof, whichever is later. We reserve the final right on the reward quotas for this Promotion.

[9] For the avoidance of doubt, you are not allowed to change the ticket price of your Ticket Reward or cancel your Registration after successful Registration.

[10] If you choose to participate in this Promotion, except WeLab Bank GoWealth Welcome Offer, WeLab Bank Existing Banking Customer GoWealth Seed Money Offer and any other Wealth Management Services related promotional offer relevant to the Concert, you are not entitled to other promotional offers relating to the Wealth Management Services during the Promotion Period, unless otherwise specified.

[11] The date and amount in our record will be final and conclusive, including but not limited to (i) the completion time of the GoWealth Investment Missions and the withholding of handling fee; (ii) date of opening, cancelling or any other variation of Core Account and / or Investment Account; (iii) Accumulated New Investment Amount of any prescribed period; (iv) number of transaction(s); and (v) completion date of each Eligible Transaction.

[12] Eligible Customers who are entitled to receiving the Ticket Rewards will receive notification via email / SMS / phone call within 10 calendar days after the Promotion Period ends (“Result Announcement Date”) according to your email address or mobile phone number registered with WeLab Bank account subject to our system record as of Result Announcement Date. Participants who are not entitled to receiving the Ticket Reward will not receive any notification. You shall redeem the Ticket Rewards according to the instructions stated in the notification. .

[13] You are responsible to log into your WeLab Bank app to confirm or update your email address and mobile phone number and ensure such information is correct. We shall not be liable for your failure or inability to be entitled to the Ticket Reward whether due to you not receiving communications or otherwise (including, but not limited to, incorrect or incomplete email address and / or mobile phone number provided by you, delay, damage, loss or accidental theft of whatsoever nature arising) and will not re-issue any notification.

[14] In the event of ticket loss (“Ticket Loss”), you are required to report the Ticket Loss to WeLab Bank. You should provide WeLab Bank with the corresponding Police Lost Property Report, your HKID Card / passport photocopies and details of the Ticket Loss (i.e. the show date, seat number and number of Ticket Loss) as soon as possible. For any tickets which are damaged or defaced that the information on it cannot be properly construed for admission, you are required to report the case to WeLab Bank and provide relevant information as requested as soon as possible. WeLab Bank will assist in handling the reported case subject to verification of relevant information. For any enquiries, please contact WeLab Bank customer service hotline at +852 3898 6988.

[15] No refund, cancellation or amendment of Ticket Rewards will be allowed unless otherwise specified.

[16] The show date(s) and seat(s) of the Ticket Reward will be distributed randomly. You are not allowed to selected specific show date(s) and seat(s), and we do not guarantee adjacent seats will be provided. No exchange will be allowed for dates, seats and ticket price category of the concert ticket.

[17] In the event of cancellation of the Concert as announced by the Organiser (as defined in Clause 20 below) (regardless of the date of announcement is within OR after the Promotion Period), affected customers will be waived from charging any handling fee for the Ticket Reward (“Fee Waiver Due to Concert Cancellation”) and any handling fee withheld from your HKD Core Account will be released in the following calendar month after the concert cancellation announcement date by the Organiser. The Bank will not issue Ticket Rewards to affected customers upon the announcement of cancellation by the Organiser. For the avoidance of doubt, only affected customers regarding cancelled shows will be entitled to the Fee Waiver Due to Concert Cancellation and the Fee Waiver Due to Concert Cancellation shall constitute full and final remedy in respect of the concert cancellation.

[18] You agree and acknowledge that you are not entitled to the Ticket Reward/Fee Waiver Due to Concert Cancellation if you close your Core Account and/or Investment Account at any time before Ticket Reward is redeemed or the withholding of any handling fee from your HKD Core Account is released .

[19] We reserve the sole and absolute right to determine your eligibility in receiving the Ticket Reward / Fee Waiver Due to Concert Cancellation at our full discretion, and we are not liable to provide any reason thereof.

[20] The Concert is organised by ESL Limited(“Organiser”). WeLab Bank is not the supplier or service provider of the Concert. We make no representation or guarantee as to the quality and availability of the Concert organised by the Organiser, or the information provided by the Organiser. We shall not be liable for any matters arising from or in connection with the quality and availability of the Concert or the information provided by the Organiser. Any complaints or disputes about the quality and availability of the Concert or any relevant information provided by the Organiser should be directed to the Organiser. Any claims and compensation you received from the Organiser will not relieve the payment or any obligation owed by you to the Bank. You shall not make any claim to WeLab Bank in relation to any cancellation, rescheduling or amendment of the Concert.

[21] The show date of the Concert shall be determined by the Organiser at its absolute discretion. The Organiser has the final right to vary or extend the show date or cancel any Concert or reduce any seat of the Concert at any time without prior notice. In the event of any dispute, the decision of the Organiser shall be final and conclusive.

[23] WeLab Bank reserves the right to vary, modify and terminate this Promotion (including but not limited to the Promotion Period, the Ticket Rewards and the Fee Waiver Due to Concert Cancellation) and to amend any of these terms and conditions at any time without any notice. In case of disputes in relation to this Promotion, WeLab Bank’s decision shall be final and binding.

[24] Any breach of applicable laws or regulations, fraud, abuse and/or non-compliance by you (as determined at our sole discretion) will result in forfeiture of your eligibility to participate in this Promotion and entitle to the Ticket Rewards/ Waiver Due to Concert Cancellation and/or suspension or termination of all or any of your Account with us. We shall not offer the Ticket Rewards/ Waiver Due to Concert Cancellation or where the Ticket Rewards/ Waiver Due to Concert Cancellation have been distributed/arranged, we reserve the right to take such necessary legal action to recover any Ticket Rewards/handling fee without notice.

[25] These terms and conditions shall be read in connection with our Account Terms and Wealth Management Services Terms. Terms defined in our Account Terms or Wealth Management Services Terms shall have the same meanings when used herein, unless otherwise defined. In the event of inconsistency between these terms and conditions, the prevailing order shall be as follows:

(i) these terms and conditions;
(ii) the Wealth Management Services Terms; and
(iii) the Account Terms.

[26] A person who is not a party to these terms and conditions has no rights to enforce or enjoy the benefit of any of its provisions under the Contracts (Rights of Third Parties) Ordinance (Cap. 623 of the Laws of Hong Kong).

[27] In the event of any discrepancy between the English and Chinese versions of these terms and conditions, the English version shall prevail.
