New WeLab Bank Customers 3HK x WeLab Bank Exclusive Welcome Promotion Terms and Conditions

When is the Promotion Period

[1] 3HK x WeLab Bank Exclusive Welcome Promotion (“Promotion”) period is from 4 November 2020 to 31 December 2020 (both dates inclusive) (the “Promotion Period”), unless otherwise specified by us.

Who can participate in the Promotion

[2] The Promotion is only applicable to you if you are a:

(a) new Welab Bank Limited (“WeLab Bank”) customer who successfully opened a bank account during the Promotion Period using (i) your registered 3HK mobile number and (ii) one of 3HK’s referral codes during the account opening application in the WeLab Bank app;

or

(b) a prospective 3HK mobile customer who has successfully ported in his mobile number to 3HK on or before (i) 15 January 2021 with a WeLab bank account opened in November 2020 or (ii) 15 February 2021 with a WeLab bank account opened in December 2020”.

[3] The 3HK referral codes are ‘5GX3HK’ or ‘3HK888’ or ‘3HK000’ or ‘3HK852’. You will not be entitled to participate in this Promotion if you use any referral codes other than those set out in this Clause.

[4] The 3HK mobile number you registered with 3HK and WeLab Bank must be identical. Otherwise, you will not be entitled to participate in this Promotion.

[5] This Promotion is not applicable to 3HK prepaid sim customers.

What is the Promotion

[6]You will be entitled to:

(a) one (1) month of your 3HK mobile service monthly basic plan fee (after netting off any rebates but excluding any charges for value added services, administration fees, licence fees), subject to a cap of HK$388 credited back to you (“One Month Fee Waiver”); and

(b) chance(s) to participate in a lucky draw (“Lucky Draw”) to win a ‘iPhone 12’ or a ‘iPhone 12 mini’. You may enjoy more chances to participate in the Lucky Draw if you fulfil the additional criteria as set out in Clause 10,

(collectively, the “Prizes”).

How to win the Prizes

[7] To be entitled to receive the Prizes, you must meet the criteria in Clause 2 and complete either of the following actions within 60 days from the date you have successfully opened a WeLab Bank account (“ WeLab Bank Account Opening Date ”):

(a) deposit and spend a minimum of HKD2,000 on Eligible Transactions (see Clause 21 - 23) by using the WeLab Debit Card (virtual and/or physical debit card)

or

(b) apply for direct debit to pay for your 3HK mobile service monthly bills (“Direct Debit”) using the WeLab Bank Debit. The Direct Debit must be maintained for at least 6 months from your WeLab Bank Account Opening Date.

One Month Fee Waiver

[8] You will receive the One Month Fee Waiver on the 6th month from the WeLab Bank Account Opening Date. You are entitled to the One Month Fee Waiver once only.

[9]The One Month Fee Waiver is provided to you directly by 3HK and it will be indicated on your 3HK monthly bills record. If you have any enquiries or disputes in relation to this One Month Fee Waiver, you should directly contact WeLab Bank at [email protected] or 3HK at https://3ichat.three.com.hk.

Lucky Draw

[10] You will have at least one (1) chance to participate in the Lucky Draw if you meet the criteria in Clause 7. For every additional spending of HKD1,000 on Eligible Transactions (see Clause 19) within 60 days from the WeLab Bank Account Opening Date, by using the WeLab Debit Card (virtual and/or physical debit card), one (1) additional chance to participate in the Lucky Draw will be allotted to you.

[11] We will calculate the additional spending amount based on the total amount of posted transactions as of the ‘Transaction Posted Cut Off’ time and date as set out in the table below in Clause 13.

[12] You may be entitled to a maximum of 11 Lucky Draw chances under this Promotion. There will be five (5) rounds of Lucky Draws under this Promotion. You may be entitled to subsequent rounds of Lucky Draws if you did not win in prior rounds. But you are only entitled to the Lucky Draw Prize once only.

[13] We will draw up to 16 winners per month (each round) from November 2020 to March 2021, on the following ‘Lucky Draw Dates’. The winners will be announced on the following dates, unless otherwise specified by us:

** special arrangement in December 2020 to accommodate the holidays.

[14] The winners will be notified by:

(a) SMS on your 3HK registered mobile number; or

(b) Email (as provided to WeLab Bank during your account opening application).

[15] The winners will be drawn by an independent third party. WeLab Bank shall have the sole discretion to determine the type of iPhone you will receive as a Prize.

[16] All redemption procedures of the Lucky Draw Prizes will be set out in a separate redemption notification sent by WeLab Bank after the announcement of the winners.

[17] At the time of redemption of the Lucky Draw Prizes, the winners must be an existing WeLab Bank and 3HK customer.

[18] Any person who does not fulfil all the above criteria will automatically be disqualified from participating in the Lucky Draw. Any person who acts in breach of applicable laws and regulations or who has an actual or potential conflict of interest will also be disqualified from participating in the Lucky Draw. No person can participate in the Lucky Draw if he/she has been involved in setting up or running this Lucky Draw

[19] The Lucky Draw Prizes are provided by the relevant manufacturers and/or suppliers. The manufacturers and/or suppliers of the Prizes are solely responsible for the quality and warranty of the products and services provided and WeLab Bank shall have no liability in this respect.

[20]. The Lucky Draw is organised by WeLab Bank. If you have any enquiries or disputes in relation to the Lucky Draw, you should directly contact WeLab Bank at [email protected] and the decision of WeLab Bank shall be final, conclusive and binding.

Eligible Transactions (as mentioned in Clause 7)

[21]“Eligible Transactions” mean purchases made at any merchant’s physical store or online store by using the WeLab Debit Card (virtual or physical debit card). Any transaction conducted in a foreign currency will be converted to Hong Kong Dollar and all transactions are determined by the transaction date of the Eligible Transaction. Reversing the transaction (including but not limited to an unposted transaction, a refund and/or cancellation of the purchase) will not be considered an Eligible Transaction.

[22] Ineligible transactions include but are not limited to:

(a) payment of banking fees and charges (including but not limited to annual fee, overdrawn fee, card replacement fee, ATM cash withdrawal fee, if applicable);

(b) quasi-cash transactions including:

(i) betting and gambling transactions;

(ii) instalment payments;

(iii) balance transfers;

(iv) cash, token, vouchers payment and/or foreign exchange transactions at non-financial institutions (including cash coupon purchases, purchase of foreign currency, money orders and travelers’ cheques); and/or

(v) any transactions at other financial institutions (including purchase of merchandise and services from banks);

(c) bank transfers (by way of Faster Payment System, SWIFT, eDDA, etc.);

(d) bill payments (including but not limited to water bills, electricity bills, insurance premiums, payments to other banks and credit cards, etc.);

(e) tax payments to the Inland Revenue Department;

(f) purchase and/or reload of stored value cards or e-wallets; and/or

(g) unposted, canceled and/or refunded transactions, in whole or in part.

[23] You have to keep all original sales slips of the Eligible Transactions. In case of any dispute, we may at any time ask you to submit these slips, and/or further documents or evidence for verification.

General Terms and Conditions

[24] To be a new WeLab Bank customer means you have not terminated and/or close your WeLab Bank account in the six (6) months prior to the commencement of the Promotion Period.

[25] All Prizes are non-refundable, non-transferable and is not redeemable for cash or other prizes.

[26] WeLab Bank and 3HK reserves the right to replace and/or cancel any Prizes at our sole discretion. WeLab Bank further reserves the right to adjust the number of Lucky Draw Prizes which will be given out.

[27] This Promotion cannot be used in conjunction with any other promotions labelled ‘Welcome Offer’ offered by WeLab Bank.

[28] Where the One Month Fee Waiver has been credited to you, WeLab Bank reserves the right to debit the amount equivalent to the One Month Fee Waiver (capped at HK$388) from your WeLab Bank account without notice and/or take such necessary legal action to recover any outstanding amounts if you cancelled or reversed any Eligible Transactions and as a result, fail to meet the requirement as set out in Clause 7 above. If you have any enquiries or disputes in relation to Clause 26, you should directly contact WeLab Bank at [email protected] and the decision of WeLab Bank shall be final, conclusive and binding.

[29] You agree and acknowledge that you will not be entitled to receive any Prizes if:

(a) you close or terminate your WeLab Bank account before the Prizes are awarded to you; and/or

(b) you terminate the mobile service contract between you and 3HK before the Prizes are awarded to you.

[30] Your eligibility to participate in this Promotion is subject to our final approval at our absolute discretion.

[31] Any breach of applicable laws or regulations, fraud, abuse and/or non-compliance by you (as determined at our sole discretion) will result in forfeiture of your eligibility to participate in this Promotion and/or suspension or termination of all or any of your account with WeLab Bank.

[32] These Offer terms and conditions shall be read in connection with WeLab Bank’s Account Terms (the “Account Terms”). In the event of inconsistency between these Promotion terms and conditions, the Account Terms, the prevailing order shall be as follows:

(a) these Promotion terms and conditions; and

(b) the Account Terms.

[33]Terms defined in WeLab Bank’s Account Terms shall have the same meanings when used herein, unless otherwise defined.

[34]WeLab Bank and 3HK reserves the right to suspend, modify or terminate this Promotion at any time and/or amend these Promotion terms and conditions at any time without prior notice.

[35] In the event of inconsistency between the English and Chinese versions of these terms and conditions, the English version shall prevail.

[36] iPhone is a trademark of Apple Inc., registered in the U.S. and other countries. Apple Inc. is not a participant in or sponsor of this Promotion.
